Before conducting a search of an Illinois resident’s home for drugs, drug paraphernalia and other items associated with drugs, police typically must secure a search warrant. In order to do so, they are required to provide probable cause for the search. When the search warrant is issued and executed, those in the home could be arrested for drug crimes. An individual arrested and charged under these circumstances retains the right to review the documentation that supposedly established probable cause for the warrant.

This right could come in handy for a woman recently arrested after a search warrant was executed in her home. Police supposedly found an unreported amount of methamphetamine and drug distribution related items. Officers also allegedly found weapons and ammunition in the home.

Because of this raid, the 54-year-old woman was arrested and now faces charges for unlawful delivery of methamphetamine and possession of weapons by a felon. She was held on two bonds — one for the drug charges for $75,000 and one for the weapons charges for $50,000. She is likely focused on reviewing the evidence that supposedly points to her guilt.

Such a review will more than likely include the details regarding the investigation that led to the issuance of the search warrant. If any mistakes were made during the investigation, any protocols not followed or any of the woman’s rights violated, the charges for weapons and drug crimes could be dismissed. Otherwise, it may be possible to negotiate a reduction of the charges, depending on the circumstances.
